If your employer is incorporated and trading, like a pty ltd company, then you are likely to be in the national system.

If your employer is a sole trader – meaning an individual person employs you, then you are in the state system.

If you are employed by a local government you are in the state system, although there are some important exceptions to be aware of.

If you work for a not-for-profit, a trustee or an aboriginal corporation, then the situation may be unclear and you may need to do further research or seek assistance.

Which system of employment law am I in?

In WA there are two systems of employment law.

If you are an employee working in WA, from an employment law perspective, you will be either a:

1. national system employee: or

2. state system employee.

It is important to know which system you are in, as it can affect your rights at work and which legal claims you can make.

 

The simple rules

For many employees, the following simple rules can be applied:

  • if you are employed by an individual sole trader, a partnership of natural persons or the state government you are in the state system.
  • if you are employed by a Pty Ltd business you are in the national system.

However, it can sometimes be difficult to figure out who your “employer” is, and for some types of employers you need to look into the rules in more detail.

 

Detailed overview

Which system you are in depends on who your employer is and what type of employer they are.

You can usually find this information by searching your employer’s Australian Business Number (ABN) on ABN Lookup: https://abr.business.gov.au/. Further guidance on this process is available below under ‘I’m unsure who my employer is and what type of employer they are. What can I do?’

You will be a national system employee if your employer:
1. is incorporated; and
2. engages in significant or substantial trading or financial activities.

Otherwise, you will be a state system employee.

You cannot be in both systems at the same time with the same employer.
